Guidance on applications for a Personal Licence

This guidance should assist you in completing and applying for a personal licence under the Licensing Act 2003.

One of the photographs must be endorsed, by a specified person (i.e. solicitor or notary, a teacher or lecturer, or other professional person).

Fees

Fees and Charges payable by applicants under the Licensing Act 2003:

The licence, unless suspended, revoked or surrendered, last for ten years with the statutory fee payable at the time of renewal.

Course content:

This will include information on your licence and local authorities, relevant offences, alcohol (strengths/effects etc), Police powers, duties, together with information about premises licences and activities etc.

These include Award in Responsible Alcohol Retailing; National Certificate for Licensees (Drug Awareness); and National Certificate for Door Supervisors.

Designated premises supervisor

All premises licences authorising the supply of alcohol must have an identified personal licence holder known as the designated premises supervisor. This ensures there is always one specified individual who can be readily identified at a premises where a premises licence is in force. This person will usually be responsible for the day-to-day running of the premises.

More than one individual at the licensed premises may hold a personal licence, although it is not necessary for all staff to be licensed. But, all supplies of alcohol under a premises licence must be made by or under the authority of a personal licence holder.

If you become a premises supervisor you will have to sign a form accepting this responsibility. This will then be submitted, possibly by the premises licence holder, with an application to change the current premises supervisor. If for any reason you then relinquish this post, you must inform us that you are doing so.

High Peak Borough Council remains your 'home' licensing authority, no matter where in England or Wales you may work. You must notify us if you move, change your name or are convicted of a relevant offence immediately.

Criminal records check

Basic criminal record checks can be obtained from Disclosure Scotland. For further details call their helpline number 0870 609 6006, or their website www.disclosurescotland.co.uk (External website**). The cost is £20.

This refers to the offences listed in the Act that could, on conviction, rule out the grant or renewal of a personal licence to the applicant concerned.

When applying for the grant of a personal licence or for the renewal of a personal licence, you must include details of any relevant or foreign offences for which you have been convicted or, in the case of applications for the renewal of the licence, which you have been convicted of since the grant or last renewal of the licence.

NB: If you are convicted of a relevant offence, you MUST inform the Court at the time you are convicted - it is an offence not to do so.

Except in the case of a TEN a personal licence does not authorise its holder to supply alcohol anywhere, but only from establishments with a premises licence authorising the supply of alcohol in accordance with the premises licence. An individual may hold only one personal licence at any one time.
