Glossop Conservation Area Committee

1. INTRODUCTION

Derbyshire County Council and High Peak Borough Council have agreed to establish a Committee for the purposes of administering grants in the Glossop Conservation Areas.

2. NAME

The Committee is to be known as the Glossop Town Centre Conservation Area Committee.

3. LEGAL POWERS

The Committee will be a Joint Committee of the two Councils under Section 101(5) of the Local Government Act, 1972.

There shall be delegated to the Committee the following powers of the Councils:

  1. The power to make grants under Sections 57 and 77 of the Planning (Conservation Areas and Listed Buildings) Act 1990 or any other appropriate power.
  2. Generally to exchange views and discuss matters of common concern within the HERS Area and make recommendations thereon.

There shall be delegated to the Strategic Director of Policy and Regeneration the Power to approve routine grant applications of up to £6,000 per property over a three year cycle, under the various Conservation Area Schemes, provided they fully meet the normal requirements of the scheme and subject to the following conditions:

Note: any applications recommended for refusal; any application where the applicant is either the Council, a member or an officer of the Council or where there is a conflict of interest will be referred to the relevant HERS Committee.

4. MEMBERSHIP

The Glossop Town Centre HERS Committee shall comprise six voting members, being three each appointed by the Borough Council and the County Council.

5. THE CHAIR

At the first meeting in each Municipal Year, the Committee shall elect a Chair and Vice-Chair from amongst the voting members.

The Chair shall alternate in each year between a person representing the Borough Council and a person representing the County Council. The Vice-Chair shall similarly alternate but the office shall be held by a person from the Local Authority not holding the Chair.

6. VOTING

Voting shall take place by a majority of all those present and entitled to vote. In the event of an equality of votes, the Chair shall have a second or casting vote.

Either Council may, by notice given orally at the meeting, or in writing to the Head of Legal & Democratic Services of the High Peak Borough Council by the close of work on the day in which the meeting is held, require that a decision reached by the Committee be not acted upon or implemented until that Council has had the opportunity further to consider the issue.

7. Delegation Sub-Committee

The Chair and Vice-Chair of a Committee shall comprise a Sub-Committee with the following powers to act on behalf of the Committee:

  1. To approve "without prejudice" starts;
  2. In any case of urgency, to authorise a Grant, provided that a report shall be made to the next available meeting of the Committee to report the circumstances, and the action taken.

8. Amendments to the Constitution

Any amendments to the Constitution must be agreed by the Borough Council and the County Council.
