Dog poop costs man £234

Date: 07/03/2007

A Glossop man who let his dog foul the Whitfield Recreation Ground (Gladstone Street Park) in Glossop, was fined at Buxton Magistrates' Court, on Friday 2 March 2007.

Roy Stafford, of 76A Gladstone Street, Glossop, failed to pay a £50 fixed penalty fine for the offence, and was prosecuted under the Dogs (Fouling of Land) Act 1996.

The Council"s environmental enforcement officer saw Stafford"s boxer dog foul in Gladstone Street Park, on 2 August 2006, and followed the dog back to 76A Gladstone Street, and spoke to Stafford, who identified himself as the dog"s owner.

It was confirmed that Stafford was in charge of the dog but he did not remove the faeces. Stafford admitted the offence and was issued with a fixed penalty notice.

Stafford received a reminder letter on 23 August 2006, but he did not pay the fixed penalty notice, even though he was given a further opportunity and an extended period to pay up.

Stafford did not appear at court, but pleaded guilty by letter. He was fined £50 and ordered to pay prosecution investigation and legal costs of £184.

Councillor Glynis Kirk, High Peak Borough Council's Executive Member for the Environment, said: "I hope this prosecution will make dog owners aware that they should not allow their dogs to roam around and foul where they please. These types of incidents are completely avoidable and we will always take enforcement action when necessary."
