Foul pet costs woman £234

A Glossop woman is facing the high cost of allowing her dog to foul the Whitfield Recreation Ground in Glossop.

She was fined fined £50 by Buxton Magistrates, on Friday 23 March 2007, and ordered to pay prosecution investigation and legal costs of £184.

Nikita Newbury, of King Edward Avenue, Glossop, was prosecuted under the Dogs (Fouling of Land) Act 1996, after she failed to pay a £50 fixed penalty fine for the offence.

The Council's environmental enforcement officer saw Newbury's dog foul in Whitfield Recreation Ground, on 7 September 2006. Newbury identified herself as the dog's owner, but she had failed to remove the faeces. This was confirmed, Newbury admitted the offence and was issued with a fixed penalty notice.

A letter was sent to Newbury the same day, confirming the issue of the fixed penalty notice, and a reminder letter was sent to her on 5 October 2006.

However, Newbury did not pay the fixed penalty notice, even though she was given a further opportunity and an extended period of time to pay up. Newbury did not appear at court, and the prosecution took place in her absence.

Councillor Glynis Kirk, High Peak Borough Council's Executive Member for the Environment, said: "Responsible dog owners keep their dogs under control and carry bags to ensure that our streets and public spaces are kept clean and hygienic. Where necessary, we will always take enforcement action against negligent dog owners - these types of incidents are completely avoidable."
