A Buxton woman, who allowed her dog to foul on Victoria Park Road, in Fairfield, was fined £75 at Buxton Magistrates Court, on Friday, March 28, 2008, and ordered to pay costs.
Kerry Halsey, of Victoria Park Road, Buxton, failed to pay a £50 fixed penalty fine for the offence, and was prosecuted under section 3, Dogs (Fouling of Land) Act 1996.
The Council's environmental enforcement officer saw Halsey's dog foul on Victoria Park Road, in Buxton, on 25 October 2007. Halsey identified herself as the dog's owner, and it was confirmed that she had failed to remove the faeces. She admitted the offence and was issued with a fixed penalty notice.
A letter was sent to Halsey the same day, confirming the issue of the fixed penalty notice. A reminder letter was sent to her on 12 November 2007. However, the fixed penalty notice was not paid, even though the defendant was given a further opportunity and an extended period of time to pay the notice.
Halsey did not appear at court. She was fined £75 and ordered to pay prosecution investigation and legal costs of £184 in her absence, along with a victim surcharge of £15. She has 28 days in which to pay the fine and costs, totalling £274.
A High Peak Borough Council spokesperson said: "Responsible dog owners keep their dogs under control and carry bags to ensure that our streets and public spaces are kept clean and hygienic. Where necessary, we will always take enforcement action against negligent dog owners - these types of incidents are completely avoidable."
