Planning Appeals

Applicants are able to appeal against the refusal of a decision of the Council or to grant permission subject to a condition or conditions that they consider onerous. Applicants can also make an appeal if the Council has failed to make a decision within the statutory period that is normally eight weeks from when the application is validated. At present there is no third party rights of appeal, where, for example a resident may wish to object to the granting of planning permission.

All appeals are managed by the Planning Inspectorate. They deal with the processing of planning and enforcement appeals and hold inquiries into local development plans.

The Planning Casework Service is developed and managed by the Planning Inspectorate, this is the government agency that runs the appeals process in England and Wales.

Types of Appeals

There are three different types of appeals that can be made:

Written Procedure

The Planning Inspectorate considers the appeal based on written evidence only submitted to it by the Council, appellants and interested third parties. The appointed inspector will also make an inspection of the appeal site and its surroundings.

Hearing Procedure

This involves a discussion of the appeal proposals which is lead by the appointed inspector where everyone concerned is provided with the opportunity to explain their views. Hearings are conducted in a more relaxed and informal atmosphere than the third type of appeal.

Inquiry Procedure

This is the formal type of appeal because it usually involves the more complicated and/or controversial appeals. Expert evidence is often presented by witnesses who are cross examined.

Details of all appeals received, whether submitted on paper or online, will be published on the Planning Portal and will be accessible through the Planning Casework Service.  These details include the name of the person or organisation making the appeal, what sort of appeal it is and how far through the appeals process the case has reached.
